TAKE CARE TRANSPORT, LLC CUSTOMER AGREEMENT, TERMS & CONDITIONS, AND WAIVER

Thank you for choosing Take Care Transport, LLC for your private transportation needs. Our mission is simply to serve the individuals in our community with a service that will help people travel to and from their destinations safely and on time in a comfortable vehicle with a first class, dependable, and caring driver. The following agreement sets forth the mutual understanding between the customer (“You” or “you”) and Take Care Transport, LLC (“Take Care”).

BOOKING OUR SERVICES

Your booking through our online system is a request for a ride, not a scheduled ride. We will respond to you with a confirmation, let you know any adjustments to your booking necessary for us to accommodate you, or inform you of our inability to provide you service. Please do not expect that you will have transportation until you receive a confirmation. When you receive your confirmation, your ride is then considered scheduled and it is your obligation to ensure that it is as you expected and that you have scheduled it to allow for traffic and other eventualities. This service is not intended for surgical or health care procedure drop off or pick up appointments and any requests for such will be denied. Take Carw is not responsible for determining who completed the booking form. When Take Care receives your ride request form, it is deemed performance to Take Care by you that you are agreeing to the terms and conditions of the ride regardless if someone has completed the form for you.

PAYMENT AND CANCELLATION POLICY

At the time of your booking, you will not be charged for the ride amount but you are agreeing to the terms and conditions of this service. Payment is due at the start of the ride. If you cancel your booking greater than 24 hours prior to a scheduled ride, you will not be subject to any cancellation policies.  If you cancel fewer than 24 hours prior to the scheduled ride, are not present and ready for pick up at the location and time your ride is scheduled to start, or do not accept the ride when it arrives, you agree to pay Take Care a cancellation fee of 50% of the quoted ride amount. If this happens more than one time, Take Care reserves the right to refuse future service.

Only Take Care reserves the right to cancel transportation due to snow, ice, or other extreme weather conditions that may pose a danger to you, our drivers, or the public. Take Care will make every effort to arrive on time for your pick up and deliver you on time to your destination but is not responsible for delayed pickups caused by unforeseen circumstances, such as weather, traffic, or mechanical breakdown.

If your ride ends sooner than scheduled, you agree that any unused time will not be refunded. If your ride takes more than 30 minutes longer than scheduled, Take Care reserves the right to charge you for the additional time. Please be sure to book the entire time you believe the trip will take knowing that if your ride runs over, another customer may be negatively affected.

CHARGES, FEES & GRATUITY

Take Care’s service area includes Columbia, Kirksville, Macon, and surrounding areas. Additional charges may apply for transportation outside Take Care’s service area. Charges are mileage based and begin at scheduled pick-up location and end when drop off is complete. We include a reasonable waiting period of 1 hour as agreed to in the quote. Our prices are subject to change, however, once booked, your price for that ride will not be changed based on a change in prices. Take Care reserves the right to add any additional charges to the original price quoted if you request to deviate from the original scheduled ride in any manner or if there is additional wait time.

All parking fees and tolls are in addition to the contract price and must be paid separately. Gratuity for your driver is not required but is always appreciated if you feel so inclined. You may pay that in cash after your ride.

ADDITIONAL PASSENGERS

If the customer being transported is under the age of 18 years, a parent or guardian will be required to accompany the minor and will not require an additional fee. Under certain circumstances, Take Care reserves the right to allow for two guardians to be transported at no extra cost. Additional passengers beyond these circumstances are subject to additional charges.

TRANSPORT FOR HEALTH-RELATED APPOINTMENTS

Take Care is a curb-to-curb transportation service designed, in part, to meet the need of non-emergency medical transportation in rural northern Missouri. Reasonable accommodations will be made, when requested at the time of booking, to help to break down, stow, and safely secure (with ratchet straps) any needed equipment in the vehicle. If you request the driver to provide you with assistance outside of the vehicle, Take Care is not responsible for any injury, death, or incident that may arise out of the assistance provided by the driver. You also consent to handling and contact by the driver to accomplish such assistance. The nature of Take Care’s business may involve some amount of disclosure of your protected health information to schedule and complete rides, such as the name, type, and location of your provider and the frequency of your visit to a health provider. Also, during the course of a ride, you may, at your sole discretion, share your otherwise protected health information with our driver. Take Care will take every effort to maintain the confidentiality of your protected health information in the manner and to the extent required by the Health Insurance Portability and Accountability Act (“HIPAA”). You and your providers are required to provide us additional information only to the extent it would limit or prevent you from using our services because of our inability to ensure your health or safety during a ride. Take Care does not take any responsibility to obtain DNR from passenger. If it is not obvious to Take Care driver DNR preference of passenger, Take Care driver follows instructions of care from 911 or driver certified training material. Take Care reserves the right to deny transportation for surgical or health care procedure drop off or pick up appointments.

TRANSPORT OF CHILDREN

It is not customary nor obligatory for Take Care to transport individuals under the age of 18. If this is necessary and you should need to take a child with you during your ride, it is your obligation to provide a car seat or booster seat appropriate to the child’s age, height, and weight per Missouri law, to ensure that the child restraint system is installed correctly using the anchors or other approved attachments available in the vehicle, and to ensure the child is properly secured in the child restraint system.

Take Care is not responsible for the safety of a child restraint system nor injury or death resulting from installation or placement of any child restraint system or the securing of the child in the child restraint system.

TRANSPORT OF ANIMALS

Subject to the discretion of Take Care or your driver, you may be allowed to bring a small pet, such as a dog or cat, on your ride. For such rides, you are responsible for properly securing the animal with a leash, harness, crate, carrier, or through other means. You are also responsible for ensuring that the animal does not cause damage or a mess in the vehicle. You may be subject to a charge for repair or cleaning for any damage or mess caused by an animal that is transported during a ride. Service animals are permitted to accompany you without extra charge. Service animals are defined as a dog of any breed or size trained to perform a task directly related to a person’s disability.

An emotional support animal, regardless of registration status, is considered a pet for purposes of this policy. You are required to notify us at the time of booking a ride whether a pet or service animal will be accompanying you.

AIRPORT TRANSFERS

If you have requested airport pick-up or drop-off service, you must provide flight information upon booking (flight number, departure/arrival times, tail number of plane, point of departure/destination) and notify us of any known changes prior to service. Additional wait time due to flight delays or baggage handling are not the responsibility of Take Care Transport and you can be charged additional wait time for the ride.

SAFETY OF PASSENGERS AND DRIVER

Your safety and the safety of our drivers is of our utmost concern.

Our vehicles are equipped with the safety equipment customary for their make, model, and year, including passive restraint systems such as front and rear seatbelts, driver and passenger air bags, approved seatbelt extenders, and child seat anchors. Seatbelts must be worn at all times in the front and back seats of the vehicle by all passengers. If you or your passengers choose to ignore or not follow driver’s requests related to safety, the ride will be terminated and you will not be entitled to a refund.

All drivers are First Aid &CPR certified and trained on assisting customers getting in and out of the vehicle, defensive driving, stowing medical equipment, and HIPAA & ADA policies. All drivers have passed a criminal background investigation, and driving record check. Our drivers are trusted employees of Take Care. As such we have implemented several protocols to ensure they are safe while they are working for us. Drivers are required to wear a seatbelt at all times while the vehicle is moving. Should the driver deem the assistance needed to, from, in or out of the vehicle, would be unsafe for you or for the driver, the driver reserves the right to deny service and payment will not be taken. If the driver believes providing the service to you poses a risk to the driver’s health or safety, the driver reserves the right to deny service.

When you avail yourself of our services, you agree that Take Care can collect the following information, images, and video of you and related to you and your ride:

(1) location of the vehicle, including location data from the vehicle based on GNSS (including using GPS), WiFi, or other localization methods, vehicle route information, and drop-off and pick-up locations;

(2) in-vehicle video footage, including footage you, your passengers, and the driver using equipment that may or not be obvious to you;

(3) in-vehicle audio recordings, which may include conversations had within or in close proximity to the vehicle with the driver, another passenger, or on a phone call;

(4) out-of-vehicle sensor data, including images and audio and video recordings using the car’s external cameras; and

(5) vehicle ride information, date, start time of ride, time of pickups and drop offs, location of pickups and drop offs, distance, route, number of passengers picked up, number of passengers dropped off, and other usage information about rides in our vehicles.

The purpose of collecting this information is to ensure the safety of you, your passengers, and our drivers, to ensure customer satisfaction and improve your experience, and to provide the service.

We will not share this information for any other reason, unless required by law, without your prior consent.

VEHICLE CLEANLINESS & SMOKING

Our vehicles are cleaned and sanitized regularly to ensure your comfort and to reduce the spread of disease. All vehicles are 100% non-smoking. If you or any passenger accompanying you fails to abide by this rule you will be liable for a cleaning fee. There will be NO EXCEPTIONS. Smoking includes cigarettes, cigars, pipes, vape pens, marijuana, or any other activity that produces smoke or vapor. There will be no illegal drug use or possession in the vehicle. Neither food nor alcohol is allowed inside the vehicle. A cleaning fee may be imposed for trash, excessive spills, vomit, and other bodily fluids. Any physical damage done to the vehicle by you, your passengers, or anyone assisting you to, into, in, out of, and from the vehicle at your request is your responsibility and may result in an assessment for repair, replacement, labor, and lost business.

ACCIDENTS AND EMERGENCY SITUATIONS

In the unfortunate event of an accident, our driver will make reasonable efforts to ensure the safety of all passengers in the vehicle. After any accident, to assist with our compliance and insurance obligations, you agree to notify us within 24 hours, provide us with all reasonable information relating to any incident or accident, and cooperate with any investigation and attempted resolution of the incident. In the case of a medical emergency, if able, the driver will call 911 and follow the directions provided by the 911 operator and first responders.

AMERICANS WITH DISABILITIES ACT

At this time para transport is not an available service with Take Care. Take Care makes every effort to accommodate individuals with disabilities. Reasonable accommodations as explained in the Transport for Health-related Appointments will be available to all passengers regardless of the purpose for the ride. Additionally, our booking website provides all available user interfaces provided by Squarespace to allow visual- and hearing-impaired customers to access and use our website. Our drivers keep a device in the vehicle that allows them to assist customers with visual or hearing impairments or to overcome language barriers between the driver and passengers.

SUBSTITUTE VEHICLES

All Take Care vehicles are meticulously maintained and serviced to prevent breakdown. Power technical equipment and mechanical components are always subject to temporary failure in any vehicle due to heat, excessive use, and conditions beyond our control. In the event of vehicle breakdown or other circumstances, Take Care reserves the right to provide a substitute vehicle or engage the services of another carrier or volunteer to complete the scheduled ride. Any time that was incurred in getting a replacement vehicle will be no additional cost to you.

LIMITATION ON LIABILITY AND WAIVER

In addition to the limitations on liability and waivers in prior sections of this agreement, if Take Care is unable, refuses, or fails to perform a requested or scheduled ride, you agree to waive any right to seek additional compensation, damages, penalties, or other such monies from Take Care, its officers, members, or employees for any damages, claims, liability, or other consequences related to such requested or scheduled ride through Take Care.

By completing this booking request, you release Take Care Transport, LLC, and its officers, members, and employees from any liability from injury to your person or damage to your property, whether real or personal, from the moment the driver arrives at the pick-up location you requested until you return to your delivery point.
